Employee information

If an employee was employed by a construction company which is subject to the Construction Workers’ Annual Leave and Severance Pay Act [Bauarbeiter-Urlaubs- und Abfertigungsgesetz] (BUAG), they will receive information on all claims that may be asserted against the Construction Workers’ Annual Leave and Severance Pay Fund [Bauarbeiter-Urlaubs- und Abfertigungskasse] (BUAK) on a quarterly basis, approximately 6 weeks in arrears.
 
Address
This information is sent to the employee’s private address. It is therefore imperative that you inform BUAK of any change in address by sending a copy of your residence registration form.
 
Starting on 1 January 2018, employee information will be provided electronically provided the employee agrees.
 
Bank account information
If the employee has not yet registered any secure bank account information with BUAK, a bank confirmation form will be included when the employee information is sent out.
 
If the bank account information changes, BUAK must be informed of the change by means of  a new bank confirmation form.

Periods of employment since start of year
All employment contracts/relationships that were reported for the given year are listed. This also applies to employment relationships that arise through holiday compensation payments from BUAK.
 
Leave entitlement
The leave entitlement includes a chronological listing of your personal leave entitlements at the time when the employee information was prepared.
 
Expiry of leave pursuant to § 7 (6) BUAG
This section of the ANI (employee information) form provides information on when leave entitlements may expire.
 
Severance pay under BUAG (old system)
This section provides information about possible severance pay entitlements under BUAG (old system, “Abfertigung Alt”).
 
Severance pay under BMSVG (new system)
If you did not fulfil the claim requirements for severance pay under BUAG by 31/12/2005, your right to severance pay is subject to the conditions of the new severance pay system [“Abfertigung Neu”] under the Corporate Employee and Self-Employed Pension Act [Betriebliches Mitarbeiter- und Selbständigenvorsorgegesetz] (BMSVG). 
 
Winter holiday provision
This section of the ANI form (employee information) provides information on your claims to an alternative entitlement to winter holiday compensation.
 
Bad weather compensation
All employees that work for companies subject to the Bad Weather Compensation for Construction Workers Act [Bauarbeiter-Schlechtwetterentschädigungsgesetz] (BSchEG) can apply for a reimbursement of wages (from the company). If you worked for at least one day in the current quarter for a company that is subject to the BSchEG, you can see whether bad weather hours have been claimed for you on the employee information form.
 
Information on complaints regarding underpayment
If it is determined that you have not been paid pursuant to Austrian collective agreement provisions, a complaint will be filed to the responsible regional administrative authorities against the business in question.
 
Information on interim supplement paid to unemployed construction workers prior to retirement
Information on weeks that can be considered for the provision on interim supplements and/or information about the interim settlement.
